MyPointPool.com (the "Pool") is open only to legal residents of the 50 United States and Washington, D.C., who are thirteen (13) years or older as of the date of entry, and are registered members of MyPointPool.com. If you are a resident of Maryland or Vermont, you are permitted to be a participant in the Pool, but are not eligible to win any of the Pool prizes listed herein. This Pool is void in all U.S. Territories, (e.g., Puerto Rico and Guam) and where prohibited by law.
2. HOW TO ENTER.
a. Enter Online. Log on to MyPointPool.com to register as a participant. Entry is open until the pool’s announced deadline or the pool is filled to the announced capacity, whichever comes first.
b. No Entry Fee Pools. Some Pools are free, requiring no entry fee to participate. These pools may or may not have promotional prizes available to the winners. Specific rules and prize structure will be available prior to signing up.
c. Entry Fee Pools. Some Pools require entry fees to participate. To compete for prizes you will need to pay the entry fee for each pool in which you wish to participate and be eligible for prizes. These entry fees are paid unconditionally by participants and are non-refundable once the Pool has started. Specific rules and prize structure will be available prior to signing up.
3. PARTICIPATION OF MYPOINTPOOL.COM.
This Pool is hosted and maintained by MyPointPool.com. MyPointPool.com and its employees are not participants in any public Pool, do not compete against participants for the prizes, nor have any financial interest whatsoever in the outcome of any pool. Participants in any game or contest sponsored by MyPointPool.com do not stake or risk anything of value other than an entry fee (if applicable) and their personal efforts in playing the game or contest, or obtaining access to the Internet.
By accepting this disclaimer, you agree to receive emails from MyPointPool.com concerning any existing services you have already subscribed to or any additional services you may be interested in subscribing to in the future.
MyPointPool.com will not authorize any third parties to send emails on our behalf.
If you refuse to accept emails from MyPointPool.com, you will no longer be authorized to use the MyPointPool.com website. No refunds will be provided in this event.
4. PRIZES/WINNER SELECTION/APPROXIMATE RETAIL VALUE/ODDS OF WINNING.
a. Prizes. Pools run from the opening game of the Pool through the final game of the pool. All prizes offered to winning participants are established and made known to the participants in advance of the start of the Pool Season. Winners of each Pool will be based on their point tallies and will not be based on the score, point spread, or any performance or performances of any single real-world team or combination of such teams. Winners will not be chosen based solely on any single performance of an individual athlete in any single real-world sporting or other event. Winners will be determined immediately following the last game of the Pool.
OVERALL PRIZES: Prize structure for each pool can be found by clicking on the pool’s name under the “Pool Prizes” link to the left.
Actual model, color, accessories and features of all prizes awarded shall be selected by MyPointPool.com in its sole discretion and may vary from photos used in print, advertising, and in electronic and web banner advertising including the MyPointPool.com web site.
Odds of winning prizes depend in part on the relative U.S. professional football knowledge and skill of the participants.
b. Substitution; Taxes. No cash or other prize substitution, assignment or transfer of prizes permitted, except at MyPointPool.com’s sole discretion due to prize unavailability. MyPointPool.com reserves the right to substitute a prize with one of comparable value or greater value (e.g., MyPointPool.com may opt instead to award the cash equivalent, up to but not greater than the ARV, of any prize in lieu of the prize itself). THE WINNER IS SOLELY RESPONSIBLE FOR ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE.
c. Prize Delivery. Pool Winners should allow three weeks from the conclusion of the Pool Season to receive their prize. Prizes returned as undeliverable or otherwise not claimed within fourteen (14) days after being sent will be forfeited.
d. No Warranty. Pool participants acknowledge that MyPointPool.com, Sponsors and Promoters and each of their respective agencies or related companies have not made, nor are in any manner responsible for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality.
5. POTENTIAL WINNERS.
a. Verification. All potential winning players are subject to verification by MyPointPool.com, whose decisions are final. MyPointPool.com shall solely determine any form of verification. A player is not a winner of any prize unless and until player’s eligibility and the potential winning entry has been verified and player has been notified that verification is complete.
b. "Prize Notice" via Email or Mail. Potential winners will be notified via email (or overnight mail) sent within fifteen (15) business days following the end of the Pool Season. Players are responsible for insuring that all mailing and e-mail information is up-to-date and accurate.
c. Alternate Potential Winners; Disqualification. A potential winner will be disqualified and an alternate potential winner will be selected (i.e., the player with the next most points) if (i) he/she does not comply with these rules (or is otherwise determined to be ineligible), (ii) he/she does not respond to the prize notice within five (5) days of its transmission (or receipt, if mailed), or if the emailed prize notice, after three (3) attempts, is returned as undeliverable, or (iii) the prize is undeliverable for any reason. If MyPointPool.com notifies, or seeks to deliver a prize to or otherwise attempts to contact an alternate potential winner, and such alternate potential winner is subsequently disqualified then MyPointPool.com shall use its reasonable business judgment to determine, in its sole discretion, the disposition of the prize (e.g., may choose another alternate potential winner in a manner consistent with these rules or donate the prize to another entity, at its sole discretion).
d. Minors. If a potential winner is a minor in his/her jurisdiction of primary residence, potential winner's parent/legal guardian must execute all documents and agree to all obligations and undertakings required of the potential winner in these Terms of Service, both on behalf of himself/herself and the potential winning minor. Prize may be awarded in the name of, or to, parent/legal guardian.
6. GAMBLING PROHIBITION. This Pool is strictly for entertainment purposes and may not be used in connection with any form of gambling.
